The network guys had added a rule and some reports' excel files being generated were treated as known vulnerabilities and blocked.

We did a create index with drop existing for each table and a SSMS rebuild index and update statistics with full scan
None of these helped with this specific issue...

Thanks for all the pointers.
We found in the BIOS the power saving setting, so now CPU-Z is set to 2100 Mhz instead of 800
However the query was still marginally faster...

I raised this with Microsoft and they have confirmed it is bug so will add the reosolution to the next CU.

The db is left in 2005 mode
I have tried 2008 mode but it made no difference.

The wierd thing from my viewpoint is that If I just back/restore from sql2005 to sql2008r2, then the problem exists, even if I restart SQL rebuild...
