Oh well - this one has not raised it's ugly head since....and the other deadlocks I have managed to work out the resolution....so all's well that ends well I suppose...fingers...

well after making it a table level trigger, everything is working fine now. I have removed the SQL Agent Job and the world is nice and calm and returning expected...

Well yes and no.
The code is working up until the point after it first raises the error; for every run of the code thereafter it creates the error again...
