Thanks for all the input, even though some was in the funny league. But I managed to convince both developer and his project manager that the code needed changing.
But a question for you, does creation of ## tables not work over a linked server, at least that was his relevant statement, why he had chosen this solution.
He clamied he could not generate temp tables via a linked server but that seem not to be a problem for me. So I will have a chat with him again
