Is there a way to keep Reporting Services from sending an email from a timed email subscription when there is no data in the report?

I'd like to know if this is possible too. I have a suspiscion someone will say you need a data driven subscription, which is only available in SQL Ent Ed.

Yeah, I looked at that, I do have Enterprise Edition, but don't want the complexity that comes with it as I am a consultant and won't be around to maintain the solution.
I did do a work around. I created the subscription and then disabled the schedule on the SQL Server Job it created. I then created another job that queries the table and runs the Report Server Email job if there are any records.
I probably should look more into using a data-driven subscription.

The explanation is more complex than the implementation as all I did was create a job that starts a job when the data has changed. Also the folks I am working for understand SQL Server jobs already and are not all that willing to look stuff up for themselves. Since they are unfamiliar with Data-Driven Subscriptions, which do not do what I need anyway, and I am will not be available to them shortly, it makes sense to use something they can understand a little easier.
