Is it not worth migrating what can be migrated to the new server and leave the legal app where it is, until it is 64 bit compliant? If it were my server, I would rather not have the mix of instances (in a prod environment) and then when they do upgrade, you have to look at disabling the 32bit instance - never fun on a PROD environment. My response to the vendor would be, that everything else on the server has been migrated, the OS is reaching the end of its support contract (as well as the hardware) and that the company has taken the decision to migrate to 64bit DB servers only, so get your A$$ in gear!!!
Might be a little harsh to just copy and paste 😉

I agree about Database collation usually being sufficient... but we fought with the vendor because they wanted us to change the TEMPDB collation when we set them up in the default Instance originally.. we ended up moving them to their own instance..
Looks like I will be rebuilding the entire Server. I cannot leave the 'legal' Instance on the existing Server until 3rd quarter (or later) and it's sounding like mixing 32bit and 64bit instances on the same Server is NOT recommended.. Thanks all for your thoughts
