Hi we currently have a fully licensed SQL server 2008 running sql reports are we covered to access data held on a sql server 2012 database only using SSRS through a one user data connection which we could get a cal for 2012? Or would every user need a cal to view the sql report generated in 2008 which we are already licensed to do ?

I would speak to Microsoft licensing to check, but my view would be you would need the same number of cal licenses or an appropriate server license for the 2012 instance. Even though you are using SQL 2008 SSRS to access the data, you are still using 2012, even if it is with one report user.
It's similar to a website where the web server is on one server and the database is on another. Multiple users may only access the web app via the web server, which uses one service account to authorise the connection and retrieve data from the database, but you still need a server license for the database and cannot use just one cal license.
I would check this with MS though to make sure.
